These Terms govern use of DataCat, operated by Individual Entrepreneur Roman Sundurov, registration number 305561086, registered at Nutsubidze Slope, Building 21, Apartment 103, Tbilisi, Georgia. By downloading or using DataCat, you agree to these Terms. If you do not agree, do not use the app.

1. DataCat service

DataCat is a macOS application for configuring market-data ingestion and creating user-owned SQLite dataset files for analysis, machine-learning workflows, and external tools. DataCat is software tooling; it is not a broker, exchange, investment adviser, or market-data provider.

Provider requests are initiated by you in DataCat and sent directly from your Mac to the selected provider. The operator does not receive your provider credentials or dataset contents, centrally host or aggregate provider data, or operate a hosted market-data delivery service.

You receive a personal, limited, non-exclusive, non-transferable, revocable license to use DataCat in accordance with these Terms and the applicable Apple terms. No ownership in DataCat or its intellectual property is transferred to you.

2. Your responsibilities

You are responsible for your provider accounts and credentials, provider fees and limits, Job configuration, local storage, backups, security of exported files, and compliance with laws and third-party terms that apply to your use. You must not misuse DataCat, interfere with its operation, bypass subscription or technical restrictions, reverse engineer it except where applicable law expressly permits, or use it to violate another party’s rights.

Market data and derived datasets may be incomplete, delayed, corrected, unavailable, or subject to provider restrictions. You are responsible for verifying data before relying on it. DataCat does not provide financial, investment, trading, tax, or legal advice.

3. Providers and external services

DataCat connects to independent data providers and uses independent service providers. Their availability, data, accounts, fees, and terms are outside the operator’s control. Your use of provider data remains subject to the applicable provider agreement even when DataCat writes the data to a user-owned file. See the Data Provider and Service Terms document for current references.

CoinAPI access uses credentials for your own CoinAPI account. Binance Global Spot access uses public unauthenticated Market Data Only endpoints. These technical access models do not replace or expand rights granted by the applicable provider terms.

4. Subscriptions and payments

Paid features may require an auto-renewable subscription purchased through Apple. Price, billing period, trial terms, renewal, cancellation, refund eligibility, and subscription management are shown by Apple at purchase and are governed by the applicable Apple Media Services terms. You can manage or cancel a subscription through your Apple account settings. Cancellation normally takes effect at the end of the current paid period.

A DataCat subscription pays for DataCat software capabilities. It does not include provider access, provider fees, a provider account, or a license to provider data.

Feature availability may depend on successful entitlement verification. DataCat may change plans or features prospectively, but changes do not remove mandatory rights provided by applicable law.

5. Your files and feedback

As between you and the DataCat operator, you retain your rights in the files you create with DataCat, subject to any rights or restrictions imposed by the original data provider or other third party. You grant the operator no right to use dataset contents merely because you created them with DataCat.

If you submit feedback, you permit the operator to use it to support, maintain, and improve DataCat without an obligation to compensate you. This does not transfer ownership of personal data or confidential materials.

6. Availability, warranties, and liability

DataCat is provided on an “as is” and “as available” basis to the maximum extent permitted by law. The operator does not guarantee uninterrupted operation, provider availability, error-free output, completeness or accuracy of market data, profitability, or fitness for a particular workflow.

To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, special, consequential, or business-loss damages arising from use of DataCat, provider outages, inaccurate data, or loss of local files. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

7. Suspension and termination

You may stop using DataCat at any time. Access may be limited or terminated if reasonably necessary to protect DataCat, users, providers, legal compliance, or subscription integrity, including for material breach of these Terms. Provisions that by their nature should survive termination remain effective.

8. Governing law and disputes

These Terms are governed by the laws of Georgia, without overriding mandatory consumer protections that apply to you. Courts with jurisdiction in Tbilisi, Georgia will have jurisdiction over disputes unless applicable mandatory law gives you the right to bring a claim elsewhere.

9. Changes and contact

These Terms may be updated when DataCat, its business model, or legal requirements change. Material changes apply prospectively and will be communicated through an appropriate channel. The effective date above identifies the current version.
